Well, we didnt do as well as we thought we would, but there is always appeal. See

Volunteer David Herrick Guilty on Two Counts Of "Selling"
My Defense Attorney Sharon Petrosino came and saw me today, and even though my max is 5
years in State Prison, she feels that the judge will either give me 1 or 2 years in county
jail which I already have plus some.
By my sentencing date June 26th, I will have a total
of 404 actual days in custody plus credit for good & work time (202) for a total of
606 days. So if he gives me 2 years that will be a "Turn Around" and if he gives
me a year that will be time off my probation.
We still have San Bernardino
(probation violation for testing positive for cannabis) to contend with, and who knows
what they are going to want... short of my head on a platter.
Since Thursdays article in the O.C. Register Metro came out,
Ive been moved into protective custody status!!!

I would like to thank Andrea Nagy (Ventura), Ellen Komp (215 Reporter) and Gene Weeks
(Adelanto) who drove many miles to attend my trial, and would like their addresses so I
can thank them personally. I also want to thank everyone else that has shown up in court
or otherwise been supportive.
I was chained to Marvin when he appeared in court on Tuesday, so
we got to talk for a while.

The following is a letter from a friend of Herricks
Dear Probation Officer,
I met David Herrick as a volunteer for the Orange County Cannabis Co-op. He was very
helpful to me by providing information on the benefits of medicinal cannabis.
Shortly after meeting Dave, A close friend named Gil Linsay was diagnosed with terminal
cancer and was given 6 months to live. Cannabis helped to ease his suffering by countering
the effects of chemo., various medications and made it easier to sleep.
He was too ill to grow any for himself, and too poor to buy from
the black market.
As a caregiver, I was unable to grow or acquire for him but I knew that Marvin
Chavez and Dave were providing cannabis to persons in need who had a doctors letter
of recommendation. After his oncologist at UCLA signed his letter
he became a member and for a short time was able to receive the cannabis at a safe
location at low (to no) cost.
It was so frustrating to sit and watch my friend suffer and to
see the relief that he experienced through his use of cannabis was proof to me that Marvin
and Dave were performing a valuable service to people who live with illness, disability
and chronic pain. I dont know where I would have gone or what I would have done
without the help that they were able to provide for me and my friend Gil.
