Medical Marijuana And The Banality of Evil In A San Francisco Courtroom
Yesterday, Canada, or rather a bureaucrat acting on its
behalf, rejected Steve Tuck’s request that it “assess” the risk he would face if
forced to return to DEAland.
Steve was understandably disturbed by this version of
“Here’s a quarter. Call somebody who cares.” No human life should be dismissed
with such incompetence and indifference to the truth, but there is nothing
personal here… Or is there?
We will have to respond in full very soon with another
appeal to the courts and I will share most of it with you at that point, but
here is just one example that demonstrates what I mean about the banality of
evil.
In his request for a “Pre-Removal Risk Assessment” (PRRA)
Tuck was only allowed to raise points that are subsequent to the rejection of
his first appeal to the Courts earlier this year. Thus, there was no reference
to his medical condition in the PRRA.
Nonetheless, in rejecting the PRRA, some bureaucrat
could write, “With respect to the issue of his medical condition, I find the
applicant has provided insufficient medical evidence that marijuana is required
in the course of his treatment…. Whether this pain and condition requires
treatment with marijuana has not been established by the applicant, beyond his
personal assertions…”
That seems reasonable, and so one might then wonder why
Steve had “provided insufficient medical evidence that marijuana is required in
the course of his treatment….”
What is Canadian for Catch 22?
The problem arose at the beginning of the refugee
process when Immigration Canada made very clear that
they would accept only the opinion of a specialist of their own choosing. But
they refused to appoint any such specialist!
In other words, because they
refused to appoint anyone there is no acceptable Canadian medical opinion on
Steve’s condition. And now they try to blame him for having “provided
insufficient medical evidence.”
Perhaps we can improve on the old saying, “There are
none so blind as those who will not see.” Should it be:
“There are none so blind as those who refuse even to look.”
I suspect that IC would not appoint a specialist for
Tuck because the specialist that they chose for Steve Kubby confirmed his cancer
diagnosis and approved of his use of cannabis to treat it. Of course, that did
not stop them from trying to undermine their own expert and send Kubby to his
death, but it did complicate things.
Our next move:
When Tuck began his first judicial appeal, his attorney
advised that it might be best if there was less publicity, so I naturally wrote
much less about his case. Unfortunately, we now know that that did not work and
so when he makes this appeal to the Canadian courts we are going to tell the
full story and it may get nasty.
Canada has repeatedly violated its own laws and Tuck’s
rights in dealing with him. When he first came up here he gave Health Canada a
huge quantity of seeds for their medical cannabis program, and then tried to
pretend it did not happen. Steve has never forced the issue, until now. This is
a story that will embarrass a lot of people and may pose yet another challenge
to all Canadian marijuana laws.

The real Golden Rule:
However, that is nothing
compared with the scandal that will erupt if he sues the RCMP for violating his
rights and the – really sacred – Canadian mining laws.

Before Steve studied botany and then became interested
in a certain plant, he had studied geology, because of his interest in caves.
Thinking that Canada might stop collaborating with DEAland’s attempts to kill
him, Steve started exploring for mining prospects near Vancouver.
The results have been spectacular and the stakes are
going to be mind-boggling. Steve is no longer just one more disabled person who
can be quietly murdered by the banality of evil. He is now the discoverer of
several world-class mining properties.

Over the next few weeks, you will be hearing a lot more
about this – about Steve’s case here on MarijuanaNews – and about the mines in
the business news. The company is privately owned, but the implications of
Steve’s discoveries will be important to the mining industry here and around the
world.
The most recent assays are now available online at http://ashlumines.com/assays-N-charts-page3.htm
these numbers will not mean anything to the average person, but to those in the
mining business will understand.
(By way of a disclaimer, I have a small interest in this
company, but my real interest remains in beating the bastards. Yesterday
shattered the last of my illusions.)
Obviously, owning a gold mine or whatever has no direct
bearing on the refugee question, but it will get the lights turned on. That is
all we really need.
Canada must look at the evil that is being committed in
its name by its bureaucracy. It is run by a clique of preening hypocrites who
call themselves “Liberals”, but the best description of Canada that I have seen
recently calls it “the glossiest, the most sophisticated and the most up-to-date
version of the illiberal state.” Canadians must take back their country, not
just from the US, but from this soulless machine.
